Welcome to Made By BiBi's Terms and Conditions. We know these types of documents are not the most fun to read, but they are important and we do reserve the right to update these over time as needed, without notice, and at our ultimate discretion.

General Disclaimer

This website is a service provided over the public internet, and a SaaS product of Shopify. As such we have limited liability for security of data in transit and at rest. We refer you to your IT Company / Department and your Telecommunications Provider's website for more information on their terms of service and responsibility for your privacy, and you can click here to visit Shopify for the same. You agree by accessing Made By BiBi technology, regardless of intent, that you are solely responsible for the durability of your own important data, distribution of your personal data and choice of providing your personally identifiable data. Once you provide data of any form to Made By BiBi, this becomes the property of Made By BiBi for use at the discretion of Made By BiBi.

Occasionally our technology may experience availability issues. In such a circumstance, you agree that Made By BiBi cannot be held liable for any alleged loss, liability, damages, injury or expense which is experienced, claimed, alleged or otherwise believed to have been experienced during such a period of degraded service. 

Unless otherwise agreed to by Made By BiBi, the contents of this website, store and catalogs and all products and services listed therein are provided an "as is" and intended for use by consumers only. If you have any questions or queries about anything you see on our site, please feel free to contact us to clarify prior to engaging in a purchase or acquisition of services offered. Except as otherwise expressly agreed in writing, Made By BiBi makes no warranties, covenants, representations or guaranties as to the quality, suitability, truth, accuracy or completeness of any of the contents of this website, or any goods that may be provided or sold in any connection with this website. Any representations, warranties or covenants with respect to any goods referred to in this website shall be subject to, governed by, and as stated in the applicable contract governing the provision of same.

In connection with your viewing and consumption of this website, the content therein and any equipment, telecommunications or technology required to access, secure and render said content, Made By BiBi will not be held liable for any harm, loss, liability, damages, injury or expense which is experienced, claimed, alleged or otherwise believed to have been experienced as a result of the interaction with any technology employed by Made By BiBi, including but not limited to (our online store, website, facebook page, facebook messenger, sms, mms, email and physical correspondence such as mail and packages). We do not approve of copying of any content hosted on our technology, should you be found to engage in this activity it may be illegal and in such cases, Made By BiBi reserves the right to prosecute such actions at the cost of the alleged perpetrator.

In no event shall Made By BiBi be held responsible or liable for any indirect, direct, special, incidental, or consequential damage (including any alleged loss of income, business, revenue, data, use profits, or other economic advantage or value) regardless of the circumstances of how this claim came to be.

You agree that Made By BiBi shall be absolutely harmless from, and you agree not to take any action against Made By BiBi for any claims based on using Made By BiBi technology.

Intellectual Property

Made By BiBi shall vigilantly defend and protect its intellectual property made available via Made By BiBi technology and general trade. The reproduction, storage, copying, mirror, re-transmission, redistribution, commercial exploitation, alternation, removal of Made By BiBi trademarks and security devices, theft or unauthorized use of any artifacts deemed to be the intellectual property of Made By BiBi will be subject to prosecution at the expense of any alleged offenders. Any illegal reproduction, theft or acquisition of creations, products, images, artwork, molds or physical property deemed to be essential to the protection of Made By BiBi property, rights, trademarks and commercial advantage, shall be prosecuted at the expense of the alleged perpetrators.

Candle Dimensions, Burn Times, Shapes, Fragrances and Colours

Our products are all hand made to strict trademark technical specifications, but as they are hand made there can be some slight variations. Additionally, each person will perceive the environment and world differently as everyone's sensory perception is subjected to different experiences and is constructed with various deficiencies and tolerances. As a result, what everyone perceives when they see, smell, touch and experience our products will differ slightly. For this reason Made By BiBi reserves the exclusive right to deem when a product is defective within reasonable tolerances in the case of alleged quality issues relating to (but not limited to): sensory interpretation, product dimensions and burn performance. Depending on many factors but not limited to: sunlight exposure, heat, chemicals in the air and surface of the product, variations in batches, variations in raw materials, and the cleaning maintenance of the products, colours may change, blend, shift or stain over time. This is normal and not considered defective. Careful consideration of placement should be made to ensure no unwanted damages to surfaces and other touching property occur through the aging of materials within our products.

You can absolutely burn our candles, but they are primarily intended as temporary, decorative art work pieces. We cannot accept returns for products that have been fully or partially burned and or combusted, or where improperly handled and maintained as per the provided care instructions.

Special Promotions

Over time we may offer special promotions to our customers. Made By BiBi reserves the right to withdraw, cancel or change any promotions at it's ultimate discretion. Customer's deliberately attempting to circumvent the limitations of promotions and exclusive offers may have their transactions reversed or cancelled and in some cases, without refund. 

Local Pickups

Local pickups should be coordinated with Made By BiBi prior to attempting collection. As most of our products are made to order, to prevent disappointment customers are encouraged to keep to these agreements and not arrive early or later than agreed. No compensation, refunds, credits or otherwise will be provided for customers attempting collection outside of an agreed window for pickup.

Local Delivery

Made By BiBi when providing a Local Delivery service, will deliver your products with care to your selected premises. Collection should take place from the delivery vehicle. At times we may deliver the product to your door, but the limitation of our duty of care for your products ends at the delivery vehicle's arrival at the agreed delivery location. Made By BiBi is not liable for any injury, loss or damages as a result of your collection from our delivery vehicle or our delivery to your door.

Postage / Shipping

Made By BiBi recommends that for products that are delicate or intricate in design that you opt for Local Pickup over postage to ensure the safest transit for your product. When you choose to post or ship your ordered products, you release Made By BiBi from all liability and responsibility for damages in transit. When postage is offered by Made By BiBi we will always endeavor to offer a postage option that includes insurance or "assurance" for one time replacement/refund of your order should shipment damages occur, and it is your exclusive choice to make use of this option or select a cheaper delivery method, if no insured or "assurance" option is available, it is still your choice to choose postage / shipping for your order and you accept the risks of carriage and agree to not hold Made By BiBi responsible for losses and damages in shipment. We do not recommend that you give delivery companies permission to leave packages unattended as they can be stolen or damaged by the elements/environment. Made By BiBi will not be held responsible for such circumstances, even if an insurance or "assurance" product was purchased, as such an action is deemed negligence. Claims relating to damages in transit will require written certification from the delivery company that an authority to leave was not given before an insurance or "assurance" product can be claimed.

Product Returns

As our products are made to order, we are unable to offer refunds or exchanges for changes of mind. All products are inspected and photographed prior to release to ensure they meet our strict quality standards. These will be referenced during investigations into defective products. In order for a defective product investigation to take place, we will need it to be returned to us for inspection, this will be at your own cost. In some circumstances we may find it acceptable to provide adequate photographic evidence to assess a claim. Should a product be found to be defective we will offer you the option of a replacement or a gift card equal to the value of the price of your purchase, less any shipping and insurance fees.

Gift Cards

You may purchase gift cards on our website and at times we may issue you a credit or refund / partial refund to a gift card. Gift Cards expire 1 year from their date of creation and can be extended for an additional 6 months if you contact us within the last month of validity, and can be used in multiple transactions. We will endeavor to email you before your Gift Card expires to ensure that you have the opportunity to leverage the value. Gift Cards are transferable to another party with a A$11.00 administration fee, however you can always purchase items for another person using your card. Purchases made from a gift card can only be refunded (if eligible) to a gift card. Gift Cards are not exchangeable for currency or other monetary mediums.

Refunds

As our products are made to order, we are unable to offer refunds or exchanges for changes of mind. Made By BiBi does not in any circumstance refund postage, shipping or insurance fees for transactions. Purchases made through services such as (but not limited to) Credit Card, Afterpay and PayPal are subject to a 25% administration fee to cover merchant transaction fees. We will reduce this administration fee to only 10% if you elect for your refund to be made to a Made By BiBi gift card. Refunds made to a bank account, credit card or via another payment provider may take up to 20 working days to clear. Please consult with your bank or payment provider if you are concerned about delays in your payment clearing. Refunds will only ever be issued to the same tender as the original purchase or at your election, to a Gift Card.

Gift Cards are non-refundable and not exchangeable for cash or other credits.

Cancellations

We understand that at times you may need to cancel your order. We will do our best to accommodate this within the terms and conditions as detailed and linked in this document. As all our orders are made to order, we will be unable to cancel an order that has begun manufacturing and in some circumstances may be able to offer a partial refund to a Gift Card.
